Policy towards Prevention, Prohibition and Redressal of Sexual Harassment of Women Employees and Students
Keshav Mahavidyalaya is committed to providing a safe and secure environment in
the Campus. The college has established an Internal Complaints Committee now
known as Internal Committee (IC) under the University Grants Commission
(Prevention, Prohibition and Redressal of Sexual Harassment of Women Employees
and Students in Higher Education Institutions) Regulations, 2015. The college has
ZERO tolerance for any kind of sexual harassment.
Sexual harassment means
(i) “an unwanted conduct with sexual undertones if it occurs or which is persistent
and which demeans, humiliates or creates a hostile and intimidating environment or
is calculated to induce submission by actual or threatened adverse consequences
and included any one or more or all of the following unwelcome acts or behaviour
(whether directly or by implication) namely:
   (a) any unwelcome physical, verbal or non-verbal conduct of sexual nature;
   (b) demand or request for sexual nature;
   (c) making sexually coloured remarks;
   (d) physical contact and advances or
   (e) showing pornography”
(ii) any one (or more than one or all) of the following circumstances, if it occurs or is
present in relation or connected with any behaviour that has explicit or implicit sexual
undertones-
   (a) implied or explicit promise of preferential treatment as quid pro quo for sexual
favours
   (b) implied or explicit threat of detrimental treatment in the conduct of work
   (c) implied or explicit threat about the present or future status of the person
concerned
   (d) creating an intimidating offensive or hostile learning environment
   (e) humiliating treatment likely to affect the health safety dignity or physical integrity
of the person concerned.
The college follows the procedure prescribed in the Regulations and the Act for
making a complaint and inquiring into the complaint in a time bound manner. An
aggrieved person is required to submit a written complaint to the IC within three (03)
months from the date of the incident and in case of a series of incidents within a
period of three (03) months from the date of the last incident.
Consequences for Sexual Harassment
. Punishment prescribed under the service rules of the organization.
· Punishment like withholding of promotion, increments, etc. The committee can also decide to terminate the employment.
· Punishment could also be deduction of compensation payable to the aggrieved woman from the wages of the respondent.
· In case if a false or malicious complaint is filed, the Committee can take disciplinary action against them.
· To take action for sexual harassment as an act of misconduct in accordance with the rules/regulations of the Company governing ‘conduct and discipline’ as applicable to the Respondent; and/or
· To deduct such amounts from the salary or wages of the Respondent as may be considered appropriate to be paid to the Complainant as per the Policy of the Company.
· Section 354, 354 A, 354B, 354 C, 354 D and 509 of Indian Penal Code, 1860 provides for punishment for offences of outraging the modesty of woman, sexual harassment, disrobe, voyeurism, stalking and insulting the modesty of woman respectively and the punishment ranges between rigorous imprisonment from 1 to 3 years AND fine or both.
Punishment for Malicious Complaint or False Evidence
If an Employee is found to have raised a malicious or false Complaint or given any false evidence, such complainant or such person making evidence may also be subject to :-
Appropriate disciplinary action, which may include termination of employment, engagement or relationship with the Company, as the case may be.
